I argue that imperatives express contents that are both cognitively and semantically related to, but nevertheless distinct from, modal propositions. Imperatives, on this analysis, semantically encode features of planning that are modally specified. Uttering an imperative amounts to tokening this feature in discourse, and thereby proffering it for adoption by the audience. This analysis deals smoothly with the problems afflicting Portner's Dynamic Pragmatic account and Kaufmann's Modal account. It also suggests an appealing reorientation of clause-type theorizing, in which the cognitive (...) act of updating on a typed sentence plays a central role in theorizing about both its semantics and role in discourse. Many philosophers think that normative judgements do not aim to represent the world. In this paper, I argue that this view is incompatible with the thought that when two people make conflicting normative judgements, at most one of these judgements is correct. I argue that this shows that normative judgements do aim to represent the world.

When doing research among vulnerable populations, researchers are obliged to protect their subjects from harm. We will argue that traditional ethical guidelines are not sufficient to do this, since they mainly focus on direct harms that can occur: for example, issues around informed consent, fair recruitment and risk/harm analysis. However, research also entails indirect harms that remain largely unnoticed by research ethical committees and the research community. Indirect harms do not occur during data collection, but in the analysis of the (...) data, and how the data is presented to the scientific and wider societal community. Highly stigmatized research subjects, like substance‐dependent parents, are especially at risk of encountering indirect harm, because the prejudice against them is so persistent. In this paper we discuss two forms of indirect harm. First, researchers have to be aware how their results will be preceived by society. Even when subjects are presented in an objective way, further, out of porportion stigmatization can occur. Researchers sometimes try to counteract this by whitewashing their results, at the risk of downplaying their respondents’ problems. The second risk researchers face is that their own normative judgements influence how they question such parents, report results and interpret statements. Researchers’ own normative judgements may influence the way they present their subjects. This article reviews a broad range of research that exhibits such indirect harms, discussing how and why indirect harms occur and formulating corresponding recommendations on how to prevent them. This chapter develops a contextualist account of normative language, focusing on broadly normative readings of modal verbs. The account draws on a more general framework for implementing a contextualist semantics and pragmatics, Discourse Contextualism. The aim of Discourse Contextualism is to derive the discourse properties of normative language from a contextualist interpretation of an independently motivated formal semantics, along with principles of interpretation and conversation. In using normative language, interlocutors can exploit their grammatical and world knowledge, (...) and general pragmatic reasoning skills, to manage an evolving system of norms. Discourse Contextualism provides a perspicuous framework for further philosophical theorizing about the nature of normativity, normative language, and normative judgment. Delineating these issues can help refine our understanding of the space of overall theories and motivate more fruitful ways the dialectics may proceed. Discourse Contextualism provides a linguistic basis for a more comprehensive theory of normativity and normative discourse and practice. (shrink)

Science-policy interactions can both facilitate and hamper professional normative judgement, i.e. a value judgement about the desirability of a certain situation. Anthropogenic land subsidence, contributing to relative sea-level rise in the economically important Western peatland areas in the Netherlands is a case in point. The implementation of mitigation, adaptation and compensation measures is lagging, partly due to science-policy interaction problems potentially leading to conflicts between stakeholders, including agrarians, climate scientists and inhabitants. We find that professional normative judgement is (...) enhanced when researchers and societal stakeholders reflect more critically on their role and engage in more inclusive science-policy interactions. This essay interrogates the relation between descriptive and prescriptive elements in Don Ihde’s philosophy of technology. I argue that while Ihde’s philosophy contributes more to normative inquiry than is often acknowledged, it may be insufficient for addressing core issues concerning cosmopolitanism, ecological catastrophe, and animal rights.

Knowledge aims to fit the world, and action to change it. In this collection of essays, Onora O'Neill explores the relationship between these concepts and shows that principles are not enough for ethical thought or action: we also need to understand how practical judgement identifies ways of enacting them and of changing the way things are. Both ethical and technical judgement are supported, she contends, by bringing to bear multiple considerations, ranging from ethical principles to real-world constraints, and while we (...) will never find practical algorithms - let alone ethical algorithms - that resolve moral and political issues, good practical judgement can bring abstract principles to bear in situations that call for action. Her essays thus challenge claims that all inquiry must use either the empirical methods of scientific inquiry or the interpretive methods of the humanities. Elqayam & Evans (E&E) drive a wedge between Bayesianism and instrumental rationality that most decision scientists will not recognize. Their analogy from linguistics to judgment and decision making is inapt. Normative models remain extremely useful in the progressive research programs of the judgment and decision making field.

Ethical theory examines human action in general terms, whereas moral judgment takes place in particular situations. These situations often cannot be subsumed easily under general norms and call for a delicate balance of norms and circumstances. I describe situations where opposing courses of action seem morally reasonable and I call them states of deliberative equilibrium. I review Aristotle’s and Kant’s conceptions of moral judgment and I offer a rule for stepping from deliberation to judgment in many situations (...) of equilibrium. (shrink)

Are all norms cognized in the same way? I present experimental evidence suggesting that they are not. I propose a distinction between two main classes of violations—the victimful and the victimless—and show that while people tend to rate acts belonging to either category as impermissible, the justifications for their judgments refer to salient features of the act only in the former case. I further show that Feinberg's distinction between harmful and offensive acts is useful in discriminating between different types of (...) victimful violations. (shrink)

Feminists have found Arendt helpful in articulating a theory of judgment across cultural differences. Embodiment enters this discussion, usually, through attention to enlarged mentality. In contrast, I approach embodiment and judgment by looking at undertheorized connections with Arendt’s conception of “thinking.” Drawing on a discussion of Boethius and Huckleberry Finn, I suggest that persons are led to thinking by lived contradictions, that is, by instances in which their experiences cannot be interpreted through dominant norms in their society or (...) culture. I also consider a claim that oppression hinders a person’s ability to be receptive to enlarged mentality, thus making it difficult for oppressed persons in Third World contexts to exercise judgment. In response, I examine how an oppressed person is receptive to meaning-making through negotiating lived contradictions. (shrink)

The question of whether old age should or should not play a role in medical decision-making for the elderly patient is regularly debated in ethics and medicine. In this paper we investigate exactly how age influences the decision-making process. To explore the normative argumentation in the decisions regarding an elderly patient we make use of the argumentation model advanced by Toulmin. By expanding the model in order to identify normative components in the argumentation process it is possible to (...) analyse the way that age-related value judgements influence the medical decision-making process. We apply the model to practice descriptions made by medical students after they had attended consultations and meetings in medical practice during their clinical training. Our results show the pervasive character of age-related value judgements. They influence the physician’s decision in several ways and at several points in the decision-making process. Such explicit value judgements were not exclusively used for arguments against further diagnosis or treatment of older patients. We found no systematic “ageist” pattern in the clinical decisions by physicians. Since age plays such an important, yet hidden role in the medical decision-making process, we make a plea for revealing such normative argumentation in order to gain transparency and accountability in this process. An explicit deliberative approach will make the medical decision-making process more transparent and improve the physician–patient relationship, creating confidence and trust, which are at the heart of medical practice. How does other people’s opinion affect judgments of norm transgressions? In our study, we used a modification of the famous Asch paradigm to examine conformity in the moral domain. The question we addressed was how peer group opinion alters normative judgments of scenarios involving violations of moral, social, and decency norms. The results indicate that even moral norms are subject to conformity, especially in situations with a high degree of social presence. This paper develops a new form of metaethical expressivism according to which the normative judgment that X should Φ consists in a decision that X Φ. When the judgment is first-personal—e.g., my judgment that I should Φ—the view is similar to Gibbard’s plan expressivism, though the state I call “decision” differs somewhat from a Gibbard-style plan. The deep difference between the views shows in the account of third-personal judgments. Gibbard construes the judgment that Mary should (...) Φ as a de se plan on the thinker’s part to Φ if she turns out to be Mary (the Subtle View). I construe the judgment as a decision for Mary that Mary Φ (the Simple View). The main argument for Simple Plan Expressivism is that it solves problems for Gibbard’s approach, resonates with a new and interesting moral psychology, and better makes sense of certain independently plausible constraints on normative judgment. In the end I argue that this account of normative judgment has implications for first-order ethics, implying in particular that rational egoism as standardly formulated is incoherent. (shrink)

The ability of a group of adults with high functioning autism (HFA) or Asperger Syndrome (AS) to distinguish moral, conventional and disgust transgressions was investigated using a set of six transgression scenarios, each of which was followed by questions about permissibility, seriousness, authority contingency and justification. The results showed that although individuals with HFA or AS (HFA/AS) were able to distinguish affect-backed norms from conventional affect-neutral norms along the dimensions of permissibility, seriousness and authority-dependence, they failed to distinguish moral and (...) disgust transgressions along the seriousness dimension and were unable to provide appropriate welfare-based moral justifications. Moreover, they judged conventional and disgust transgressions to be more serious than did the comparison group, and the correlation analysis revealed that the seriousness rating was related to their ToM impairment. We concluded that difficulties providing appropriate moral justifications and evaluating the seriousness of transgressions in individuals with HFA/AS may be explained by an impaired cognitive appraisal system that, while responsive to rule violations, fails to use relevant information about the agent’s intentions and the affective impact of the action outcome in conscious moral reasoning. A central source of support for expressivist accounts of normative discourse is the intimate relationship between normative judgment and motivation. Expressivists argue that normative judgments must be noncognitive, desire-like states in order to be so tightly linked with motivation. Normative statements are then construed as expressions of these noncognitive states. In this paper, I draw on dual-process models in cognitive psychology to respond to this argument. According to my proposal, normative judgments are ordinary beliefs (...) that are typically produced by two kinds of process: intuitive-affective processes and domain-general reasoning. When produced by the first kind of process, motivation and judgment tend to align. When produced by the second kind, motivation and judgment might not align. Since the first kind of process is the most common pathway of normative belief formation, normative judgments are typically accompanied by aligning motivation. This proposal enables cognitivists to explain the intimate link between normative judgment and motivation, thereby removing the major obstacle to interpreting normative statements truth-conditionally. To naturalize normative judgment is to give some account of it, in naturalistic and non-normative terms. Simon Blackburn’s Ruling Passions embraces naturalism, about ethics especially.

Human beings orient themselves in the world via judgments; factual, moral, prudential, aesthetic, and all kinds of mixed judgments. Particularly for normative orientation in complex and contested contexts of action, it can be challenging to form judgments. This paper explores what one can reasonably expect from a theory of the power of judgment from a Kantian approach to ethics. We reconstruct practical judgments on basis of the self-reflexive capacities of human beings, and argue that for the subject to (...) see himself as committed to prudential goods it is necessarily implied that he understands himself as committed to moral judgment. However, to understand the normativity of understanding oneself as a being with practical commitments at all, the aesthetic judgment is introduced: the power of judgment in its pure form of selfreflexivity. We claim that aesthetic reflection and judgment is conditional on the possibility for human beings to enter the space of reasons, and therewith for practical self-understanding as such. The paper concludes with a preliminary sketch of different conceptual possibilities in fleshing out the role of the power of judgment in its aesthetic employment in developing mixed judgments. According to one interpretation of Aristotle’s famous thesis, to say that action is the conclusion of practical reasoning is to say that action is itself a judgment about what to do. A central motivation for the thesis is that it suggests a path for understanding the non-observational character of practical knowledge. If actions are judgments, then whatever explains an agent’s knowledge of the relevant judgment can explain her knowledge of the action. I call the approach to action that (...) accepts Aristotle’s thesis so understood Normativism. There are many reasons to doubt Normativism. My aim in this paper is to defend Normativism from a pair of arguments that purport to show that a normative judgment could not constitute an event in material reality and also the knowledge of such a happening. Both highlight a putative mismatch between the natures of, on the one hand, an agent’s knowledge of her normative judgment and, on the other, her knowledge of her own action. According to these objections, knowledge of action includes (a) perceptual knowledge and (b) knowledge of what one has already done. But knowledge of a normative judgment includes neither. Hence knowledge of action cannot simply be knowledge of a normative judgment. (shrink)

Using Natural Language Processing tools, the current study explores the evolution of objectivity practice in terms of attitude injection. Adopting the indicator of moral loading under the Moral Foundation Theory framework, it examined the moral judgments embedded in 20,679 culture war news articles published in five major U.S. newspapers from 1980 to 2021. Our findings revealed a distinct mixed journalistic liberal pattern and an apparent paradox in objectivity practice: the less moral judgments, the more liberal tendencies, which could be caused (...) by journalists’ watchdog role and the increase of liberal components in U.S. democracy. We then argue that the performance of traditional objectivity has remained robust, especially when accounting for the degree to which moral judgments can be attributed to source quotations. The study contributes to the literature by bridging moral psychology and the enactment of journalistic norms, applying MFT to evaluate degrees of objectivity in news. (shrink)

The article focuses on Oakeshott’s attempt to maintain a categorial distinction between political philosophy and normative prescription. It accepts the thrust of Oakeshott’s argument against rationalism in politics, but contends that the residual normative dimension in Oakeshott’s thinking should not be dismissed as philosophically irrelevant. The article takes seriously the practical demands made on agents in difficult circumstances. It focuses specifically on what may be said to be going on when we ‘pursue intimations’. By concentrating on what Oakeshott (...) actually does (rather than what he claims to be doing) the article places Oakeshott much closer to the mainstream in western political philosophy. (shrink)

Autonomous vehicles —and accidents they are involved in—attest to the urgent need to consider the ethics of artificial intelligence. The question dominating the discussion so far has been whether we want AVs to behave in a ‘selfish’ or utilitarian manner. Rather than considering modeling self-driving cars on a single moral system like utilitarianism, one possible way to approach programming for AI would be to reflect recent work in neuroethics. The agent–deed–consequence model :3–20, 2014a, Behav Brain Sci 37:487–488, 2014b) provides a (...) promising descriptive and normative account while also lending itself well to implementation in AI. The ADC model explains moral judgments by breaking them down into positive or negative intuitive evaluations of the agent, deed, and consequence in any given situation. These intuitive evaluations combine to produce a positive or negative judgment of moral acceptability. For example, the overall judgment of moral acceptability in a situation in which someone committed a deed that is judged as negative would be mitigated if the agent had good intentions and the action had a good consequence. This explains the considerable flexibility and stability of human moral judgment that has yet to be replicated in AI. This paper examines the advantages and disadvantages of implementing the ADC model and how the model could inform future work on ethics of AI in general. (shrink)

This paper is a discussion of the ‘moralization’ of resentment in Adam Smith’s Theory of Moral Sentiments. By moralization, I do not refer to the complex process by which resentment is transformed by the machinations of sympathy, but a prior change in how the ‘raw material’ of the emotion itself is presented. In just over fifty pages, not only Smith’s attitude toward the passion of resentment, but also his very conception of the term, appears to shift dramatically. What is an (...) unpleasant, unsocial and relatively amoral passion of anger in general metamorphoses into a morally and psychologically rich account of a cognitively sharpened, normatively laden attitude, an attitude that contains both the judgment that the injury done to me was unjust and wrongful, and the demand that the offender acknowledge its wrongfulness. Two very different readings of ‘Smithean resentment’ are thus available from the text. Indeed, the notion of two distinct forms of resentment – an instinctive, amoral version and a rich, rationally appraising attitude – would bring Smith into line with an earlier account of resentment, found in Bishop Joseph Butler’s Fifteen Sermons Preached at Rolls Chapel, first published in 1726. Ultimately, I argue, the differences in their theories are to Smith’s credit. It is precisely because the ‘thin’ or generic retaliatory passion described in Part I can be reconciled with the rich, normative attitude in Part II, that Smith is able to accomplish his meta-ethical goal of grounding moral judgments in naturally occurring emotions. Bart Streumer believes that the following principle is true of all normative judgements: When two people make conflicting normative judgements, at most one of them is correct. Streumer argues that noncognitivists are unable to explain why is true, or our acceptance of it. I argue that his arguments are inconclusive. I also argue that our acceptance of is limited in the case of instrumental and epistemic normative judgements, and that the extent to which we do accept for (...) such judgements can be explained by an assumption of shared standards of correctness. My overall strategy is to argue that norms of judgement derive from moral or personal values, particularly when such values are attached to the end of truth. While there are philosophical problems associated with both moral and personal values, they are not special to the realm of judgement, nor peculiar to naturalist philosophies. It agrees, however, that a theory of content that locates norms 'inside' content will not be forthcoming-at least if this is to require fashioning the norms that in some sense govern judgment or thought into individually necessary conditions for contentful states. Beginning by offering an overview on legal aesthetic humanisms as a specific embodiment of critical discourse, and discussing the ways the recreation of juridical experience, rationality, and culture underpinning such a criticism, leaving behind monolithic views on textuality, judgment, and subjectivity, positively contributes to unsettling the main assumptions underlying typical understandings of law’s autonomy—mostly those of formal specification of juridical “sources” and “scientific” isolation of legal thought—, this paper argues that simply reproducing aesthetic heterodoxy as the epitome of a (...) humanist ‘alternative to law’, without first debating the very orthodox-heterodox binomial, ends up overlooking the discursive and methodological specificity of law, as a particular experience of practical and normative validity. In this way, it introduces, from an axiological-normative and juridically oriented standpoint, a different—jusaesthetic—argument for re-examining the relationship between law’s praxis, nomos, and community. This paper argues that moral particularism, defined as the view that moral judgment does not require moral principles, depends upon a constricted and untenable view of rational judgment as simple syllogistic ratiocination. This I demonstrate by re-examining Nussbaum’s (1986/2002) case for particularism based on Sophocles’ Antigone. The central role of principles in moral judgment and in educational theory is supported by explicating ‘mature judgment’, which highlights key features of Thomas Green’s account of norm acquisition and of (...) The construction industry is typically characterized as a fragmented, multi-organizational setting in which members from different technical backgrounds and moral values join together to develop a particular business or project. The most challenging obstacle in the construction process is to achieve a successful practice and to identify and apply an ethical framework to manage the behavior of involved specialists and contractors and to ensure the quality of all completed construction activities. The framework should reflect a common moral ground for myriad (...) people involved in this process to survive and compete ethically in today’s turbulent construction market. This study establishes a framework for moral judgment of behavior and actions conducted in the construction process. The moral framework provides the basis of judging actions as “moral” or “immoral” based on three levels of moral accountability: personal, professional, and social. The social aspect of the proposed framework is developed primarily from the essential attributes of normative business decision-making models identified in the literature review and subsequently incorporates additional attributes related to professional and personal moral values. The normative decision-making models reviewed are based primarily on social attributes as related to moral theories. The professional and moral attributes are established by identifying a set of common moral values recognized by professionals in the construction industry and required to prevent common construction breaches. The moral framework presented here is the complementary part of the ethical framework developed in Part I of this article and is based primarily on the personal behavior or the moral aspect of professional responsibility. The framework can be implemented as a form of preventive personal ethics, which would help avoid ethical dilemmas and moral implications in the first place. Furthermore, the moral framework can be considered as a decision-making model to guide actions and improve the moral reasoning process, which would help individuals think through possible implications and the consequences of ethical and moral issues in the construction industry. Behavioural welfare economics has lately been challenged on account of its use of the satisfaction of true preferences as a normative criterion. The critique contests what is taken to be an implicit assumption in the literature, namely that true preferences are context-independent. This assumption is considered not only unjustified in the behavioural welfare economics literature but unjustifiable – true preferences are argued to be, at least sometimes, context-dependent. This article explores the implications of this ‘critique of the inner rational (...) agent’. I argue that the critique does not support a wholesale shift away from the use of true preferences as an evaluative standard in normative economics; instead, the critique implies that behavioural welfare economists need to inquire into and establish the ‘source’ of particular context-dependent choices in individuals’ decision-making. The source determines the permissibility of correcting individuals’ context-dependent choices and can, in some situations, support decisive welfare judgements. (shrink)

The historical specificity of Michel Foucault’s practice of critical genealogy offers a valuable model for political theory today. By bringing into focus its historical attention to detail, we can locate in Foucault’s genealogical philosophy an alternative to prominent assumptions in contemporary political theory. The work of political theory is often positioned in light of an assumed goal of staking political theory to certain political positions, judgments, or normative determinations that already populate the terrain of politics. This goal may be (...) illusory; certainly it is not requisite. The alternative model of political theory in Foucault’s work involves resolutely refusing to take positions in politics so as to enact specific critical politicizations on the terrain of the political. Such a practice of ‘critique without judgment’ is dependent upon the historical attention to specificity brought to bear in genealogical work. This history-centered genealogical model is instructively exemplified in Foucault’s under-discussed introduction to his book Herculine Barbin. Foucault’s curation and discussion of the Barbin dossier offers a concise account of how Foucauldian genealogy engages with historical specificity in order to politicize its objects of inquiry without reducing its own work to the task of issuing a political judgment. The aim of this article is to contribute to the formulation of a non-excluding concept of solidarity which is of relevance to contemporary society. The assumption is that in the present individualized and culturally diverse society there is an urgent need for a new form of solidarity to create social cohesion. The central theme is that contemporary solidarity is about recognition and a fair distribution of chances for recognition. This ideal may function as a normative standard for critical research (...) and as a guideline for people in their moral struggles. What ultimately needs to be done is not a purely theoretical question but something which must be settled by a judgement that constitutes a battlefield where conflicting values and perceptions of reality confront each other. There is a large tradition of work in moral psychology that explores the capacity for moral judgment by focusing on the basic capacity to distinguish moral violations (e.g. hitting another person) from conventional violations (e.g. playing with your food). However, only recently have there been attempts to characterize the cognitive mechanisms underlying moral judgment (e.g. Cognition 57 (1995) 1; Ethics 103 (1993) 337). Recent evidence indicates that affect plays a crucial role in mediating the capacity to draw the (...) moral/conventional distinction. However, the prevailing account of the role of affect in moral judgment is problematic. This paper argues that the capacity to draw the moral/conventional distinction depends on both a body of information about which actions are prohibited (a Normative Theory) and an affective mechanism. This account leads to the prediction that other normative prohibitions that are connected to an affective mechanism might be treated as non-conventional. An experiment is presented that indicates that “disgust” violations (e.g. spitting at the table), are distinguished from conventional violations along the same dimensions as moral violations. In this paper, I suggest that we need to enrich our discussion of meta-normativity in the philosophy of art by moving beyond the traditional focus on aesthetic value, the putative properties underwriting such value, and the related concepts, discourse, and judgments. When it comes to much of the normativity arising in our engagement with art (in interpretation, performance, staging, display, and appreciation) such matters of aesthetic value are not decisive, and they are often beside the point. In these spheres, the (...) key normative issue instead often turns on the notion of being appropriate, both a) as a matter of general policy, relating to the appropriateness of a manner of staging, interpretation, etc., and b) as a matter of whether some particular staging, interpretation, etc., is appropriate for a given work, given its features, the context, and so on. Thus, I go on to argue, the extensive debates about objectivity and subjectivity in aesthetic judgment, and related issues, will be of little help when it comes to settling some of the key meta-normative questions in philosophy of art. We need to ask, when it comes to appropriateness, whether a claim to the effect, e.g., that ‘x is appropriate manner of staging y’ could really be right, and if so, in virtue of what. In the recent epistemological literature much has been written about the nature of suspending judgement or agnosticism. There has also been a surge of recent interest in the nature of ignorance. But what is the relationship between these two epistemically significant states? Prima facie, both suspension and ignorance seem to involve the lack of a correct answer to a question. And, again prima facie, there may be some intuitive attraction to the idea that when one is ignorant whether p, one (...) ought to suspend judgement whether p. In this paper we will explore a range of different possible normative connections between ignorance and suspension of judgement. We will also discuss how both ignorance and suspension are related to having inconclusive evidence. As we will see, the issues can become quite complex due to the fact that there are different, competing views about the nature of ignorance and also about the nature of suspension. Moreover, there are importantly different kinds of epistemic norms. Our overall aim then will be to systematically chart how these different choices will impact the possible normative connections between ignorance and suspension. (shrink)

Hannah Ginsborg presents fourteen essays which establish Kant's Critique of Judgment as a central contribution to the understanding of human cognition. The papers bring out the significance of Kant's philosophical notion of judgment, and use it to address interpretive issues in Kant's aesthetics, theory of knowledge, and philosophy of biology.

Empirical studies on people's moral attitudes regarding ethically challenging topics contribute greatly to research in medical ethics. However, it is not always clear in which ways this research adds to medical ethics as a normative discipline. In this article, we aim to provide a systematic account of the different ways in which attitudinal research can be used for normative reflection. In the first part, we discuss whether ethical judgements can be based on empirical work alone and we develop (...) a sceptical position regarding this point, taking into account theoretical, methodological and pragmatic considerations. As empirical data should not be taken as a direct source for normative justification, we then delineate different ways in which attitudes research can be combined with theoretical accounts of normative justification in the second part of the article. Firstly, the combination of attitudes research with normative-ethical theories is analysed with respect to three different aspects: The extent of empirical data which is needed, the question of which kind of data is required and the ways in which the empirical data are processed within the framework of an ethical theory. Secondly, two further functions of attitudes research are displayed which lie outside the traditional focus of ethical theories: the exploratory function of detecting and characterising new ethical problems, and the field of ‘moral pragmatics’. The article concludes with a methodological outlook and suggestions for the concrete practice of attitudinal research in medical ethics. (shrink)

David Papineau [1999. “Normativity and Judgement.” Proceedings of the Aristotelian Society 73 : 16–43.] argues that norms of judgement pose no special problem for naturalism, because all such norms of judgement are derived from moral or personal values. Papineau claims that this account of the normativity of judgement presupposes an account of content that places normativity outside the analysis of content, because in his view any accounts of content that place normativity inside the analysis of content cannot explain the normativity (...) of judgement in the derivative way he proposes. Furthermore, he argues that normative accounts of content along those lines are independently problematic. ABSTRACT The paper proposes that the distinctive features of aesthetic assertion are due to a special norm governing such assertion rather than any semantic features of aesthetic predication. The norm is elaborated as a reading of Kant’s analysis of aesthetic judgment. Apart from the proposed norm capturing various features of aesthetic assertion, it is supported by various linguistic considerations that point to the semantic profile of predicates of personal taste and aesthetic predicates being in fact alike with respect to (...) the role of a judge or experiencer in the interpretation of the respective kinds of assertions. The difference between the two, therefore, must have a different source than the understood role of an agent, viz. the advertised norm. In particular, it is argued that the role of an explicit agent in both predicates acts to signal a presupposition of another agent having a different experience or judgment from the speaker rather than an articulation of the content of the predicate itself or a determination of its truth value.
